Registrar Brandon Gray Internet Services Loses License to Sell .CA Domains

(WEB HOST INDUSTRY REVIEW) — A Canadian domain registrar affiliated with a reseller that the Canadian Internet Registration Authority (www.cira.org) says has sent out misleading renewal notices to domain owners has lost its license to sell dot-ca domains, according to a report by IT Business.

Markham, Ontario-based Brandon Gray Internet Services (https://namejuice.com) lost an injunction request on January 27 to keep its license pending an upcoming trial against CIRA involving a $10 million lawsuit.

The company first had its licence terminated September 10, according to court documents.

One of Brandon Gray’s resellers was Domain Registry of Canada (www.droc.ca), which the CIRA said recently sent “misleading ‘renewal’ notices to dot-ca domain holders.”

Madam Justice Cory Gilmore’s decision could potential lead to future legal issues between Brandon Gray and CIRA.

In her ruling, Justice Gilmore said that Brandon Gray may adhere to the recertification regulations, and that CIRA did not give the domain registrar a chance to respond to the CIRA’s issues about being associated with DROC.

Gilmore writes: “There is a serious issue to be tried in relation to whether or not CIRA breached its agreement with Brandon Gray. CIRA does not have unfettered discretion to refuse Brandon Gray’s application.”

In its defense, Brandon Gray said in court that DROC had only contacted its own customers about the service.

It also said that CIRA never inquired about the registrar’s relationship with DROC, nor did it ask the company to cease doing business with the reseller.

The registrar said in court that “the conduct of DROC… has nothing to do with Brandon Gray.”
