December 31, 2002 — (WEB HOST INDUSTRY REVIEW) — Domain name registration and Internet services provider Register.com Inc. (Register.com) announced on Monday that the US District Court for the Southern District of New York has delivered a preliminary injunction against the questionable marketing tactics of Domain Registry of America Inc.

The preliminary ruling enjoins Domain Registry of America, a domain name registration reseller, from committing any acts likely to cause Register.com customers to believe that DROA is their existing registrar. The court also enjoined DROA from making representations likely to lead customers to believe the company is affiliated with Register.com.

Register.com’s lawsuit, filed in August 2002, alleges that Domain Registry of America used deceptive marketing tactics, including the misuse of Register.com’s name and trademark, and using misleading materials to confuse Register.com customers into believing they were renewing their domains with Register.com, when they were actually transferring their domains to Domain Registry of America.

“We see the court’s decision today as a victory for our customers, who were the victims of Domain Registry of America’s deceptive marketing tactics,” said Richard D. Forman, President and CEO of Register.com. “We hope that this outcome sends a clear message to those who attempt to trade off of Register.com’s brand and reputation.”
