Three Respondents Added to Aussie MP3 Case

November 17, 2003 -- (WEB HOST INDUSTRY REVIEW) -- According to Australian IT, an Australian information technology news site,

three new respondents have been added to a civil lawsuit

recently filed by the Australian music industry against an Internet Service

Provider.

Last month, the Australian music industry has filed a lawsuit against E-

Talk Communications (etalk.net.au), an

Australian Internet Service Provider, over allegedly profiting from

mp3s4free.net, a site that reportedly provided links to MP3 files. On

Friday, Australian IT reported that three individuals including Liam

Francis Bal, Director of ISP and Web hosting provider Com-Cen, and E-Talk,

an ADSL ISP, had been named as respondents.

According to Australian IT, Com-Cen's lawyers have argued there was no

breach of copyright because the site only linked to the MP3 files, and will

contest the inclusion of the new respondents.

The applicants in the lawsuit include Universal Music Australia, EMI Music

Australia, Sony Music Entertainment (Australia), Warner Music Australia,

BMG Australia and Festival Records. A date for the next hearing will be set

later this month.
