June 27, 2005 – (WEB HOST INDUSTRY REVIEW) — According to reports, strengthened federal record-keeping regulations applying to adult content sites will not be enforced for members of adult entertainment industry trade group Free Speech Coalition as scheduled starting June 23.
The June enforcement date has been extended to September 7 as a result of a deal between the Free Speech Coalition and the Department of Justice. The Free Speech Coalition is fighting the legality of the regulations.
According to reports, the new regulations require primary producers of adult content to maintain extensive documentation of performers, verifying age, name and identity for seven years. Companies that leave the adult business are required to maintain records for five years.
The stipulations apply to secondary producers, such as Webmasters, as well. However, distributors such as Web hosts, ISPs and content delivery service providers are exempt, reports say.
Members of the adult industry argue that the regulations invade the privacy of adult performers. The deal applies only to those organizations that register with the FSC before June 25. Current members must confirm their membership before June 27.
Prior to the new regulations, adult Web sites were not subject to the Child Protection and Obscenity Enforcement Act of 1988, which set out record-keeping rules for adult magazines and videos.
