Interland Publishes Anti-Spam Guide

March 4, 2004 -- (WEB HOST INDUSTRY REVIEW) -- Web hosting provider Interland (interland.com) released the results of a recent nationwide survey on Wednesday, revealing that small businesses in the United States have a very poor understanding of the new CAN-SPAM act that went into effect on January 4.

The CAN-SPAM Act creates administrative, civil and criminal tools to help US consumers and businesses combat spam, placing various restrictions on commercial email but allowing certain forms of unsolicited commercial email that is clearly marked as an advertisement and leaves recipients the option to unsubscribe.

According to the results of Interland's study, which surveyed small business owners, 62 percent of respondents had either never heard of the CAN-SPAM act or were unaware of how it affected their business. Interland said the results prompted it to publish an anti-spam guide that explains the CAN-SPAM legislation in detail and offers small business owners tips on how to conduct online marketing while still remaining in compliance with the new law. The 13-page guide, which contains articles, tips and resources, is designed specifically for small business owners and is available from Interland free of charge.

"Companies caught unaware of the new law but engaged in email marketing could be in for an expensive lesson," says Jonathan Wilson, vice president and general counsel at Interland. "The CAN-SPAM Act creates very specific requirements for commercial emails, including both civil and criminal penalties for violations. We have recently seen a flurry of litigation surrounding unauthorized downloading of music from peer-to-peer networks, and it is very likely that, sooner or later, some unaware small business is going to feel the power of this new anti-spam law in a similar way."

I was a little surprised by how difficult it became to see this idea through. We set out to assemble a blueprint for a small hosting business, but butted up pretty quickly against the general impossibility of covering all the territory that was out there to be covered. The basic constraints of a printed magazine, and the less-than-infinite amount of time we had available forced us to face the fact that we could never produce an exhaustive guide to starting a hosting company.
