August 22, 2003 — (WEB HOST INDUSTRY REVIEW) — F5 Networks, Inc. (f5.com), a provider of application traffic management products and NetScaler, Inc. (netscaler.com), an application intelligent networking company, jointly announced yesterday the settlement of a patent dispute surrounding F5 Networks? patented “Cookie Persistence” technology.

F5?s Cookie Persistence technology enhances traffic management and load balancing products by using an HTTP cookie stored on the user’s machine to allow the customer to reconnect to the same server previously visited at a Web site.

“NetScaler’s interest in licensing our Cookie Persistence patent is an important validation of the value this patent holds within the industry and of the technology we create at F5,” said John McAdam, president and CEO of F5 Networks. “This settlement between F5 and NetScaler helps to protect F5 Networks’ intellectual property.”

As part of the settlement, the two companies will enter into a cross-license agreement. NetScaler will license the F5 Cookie Persistence patent and pay an undisclosed licensing fee. F5 Networks will license a NetScaler patent for a technology that improves the performance of network infrastructures by freeing servers from processing loads.
